Bill of Rights and Guide Updates for Home Care, Hospice & Outpatient Surgical Centers
Purpose:
The purpose of this information bulletin is to inform home care and hospice providers regarding the following:
- The Minnesota Department of Health's, A Guide to Home Care Services is now available on the MDH website; and
- Changes were made in the Home Care Bill of Rights by the 2001 Minnesota Legislature. The Home Care Bill of Rights was updated September 2004.
- A separate Hospice Bill of Rights, reflecting the hospice rules and statutes, is to be used by licensed hospice providers. The 2005 Minnesota Legislature revised the Hospice Bill of Rights to be effective August 1, 2005.
- Changes were made in the Patient Bill of Rights by the 2004 Minnesota Legislature to include the statement, "Patient also means a person who receives health care services in an outpatient surgical center."
1. Guide to Home Care Services and Guide to Hospice Services:

A separate "A Guide to Hospice Services" reflecting the hospice rules and statutes, is to be used by licensed hospice providers, effective Sept. 26, 2004. This document is available for download from the Hospice Licensure page.
Note: The department will NOT send out a new information bulletin when revisions are made to this Guide. Changes will be made directly on the MDH website and a date noted on the document.
2. When will the revisions in the Home Care Bill of Rights be effective?
The revisions to the Minnesota Home Care Bill of Rights were effective October 1, 2001.
Minnesota Home Care Bill of Rights number 16 was modified relating to advance notices. The revised copies of the Minnesota Bill of Rights, with the 2001 revisions, must be implemented and provided to all clients no later than Jan. 31, 2002, by licensed home care/hospice providers in Minnesota.
Effective Feb. 1, 2002, for surveys and complaint investigations, deficiencies will be issued for non-compliance with the 2001 changes to the Minnesota Bill of Rights.
The Home Care Bill of Rights has been updated, effective Sept. 26, 2004. The Home Care Bill of Rights has not changed, but the document has been reformatted for clarification.
A separate "Hospice Bill of Rights" reflecting the hospice rule and statutes, is to be used by licensed hospice providers.
