Municipal Well Ownership Requirements

Documentation for Proof of Ownership of Legal Control

Ownership Documentation (must include one of the following)

  • Copy of the property deed or permanent easement that states the name of the owner of the public water supply system.
  • Notarized letter or affidavit stating that the owner of the public water system owns or legally controls the property.
  • Parcel identification number (PID) and notarized letter or affidavit stating that the PID number is for the property shown on the site plan or map.
  • If the property ownership or legal control is not yet finalized at the time of plan submittal (example: there is an option to purchase the land depending on drilling results), the PWS must provide a copy of the pending purchase agreement. A copy of the final property deed must be submitted to MDH once the purchase/easement agreement is finalized.

Location Documentation (must include both)

  • Site plan showing the location of the well and all relevant features within 200-feet that requires a setback distance specified in Minnesota Rules 4725, including buried utilities and property boundaries. The site plan should also include the property/easement boundaries.
  • Geographic coordinates for the proposed well location in a commonly used format (latitude-longitude or UTM coordinates) and with adequate precision so the well location can be plotted within 10-feet (3 meters) or its proposed location. For latitude-longitude, provide coordinates to at least 5-deccimal degrees (0.00001).
